CAC Registration Terms
These terms govern the facilitation of your business and corporate registrations with the Corporate Affairs Commission (CAC) through our agency.
1. Purpose
These CAC Registration Terms apply specifically to services provided by Berhiz Technologies relating to business-name registration, company registration, and other Corporate Affairs Commission (CAC) registration or related filing services.
They supplement the Website Terms & Conditions and any applicable quotation, package description, application instructions, or written engagement.
2. Role of Berhiz Technologies
Berhiz Technologies acts as a private service provider and facilitator assisting clients with CAC-related registration and filing processes.
Berhiz Technologies is not the Corporate Affairs Commission and does not represent itself as a government agency, government department, or official CAC office.
3. CAC Authority
CAC is responsible for its own systems, processes, requirements, decisions, approvals, rejections, name availability determinations, certificates, records, official fees, and regulatory requirements.
Berhiz Technologies cannot control CAC decisions, system availability, processing times, regulatory changes, or requirements imposed by CAC or other government authorities.
4. Registration Packages and Perks
The exact services included in a CAC package (Standard or Premium) are determined by the package description, payment selection, quotation, or written agreement applicable to the client's transaction. This applies to both Business Name Registration and Limited Liability Company (LTD) Registration.
Core statutory services (such as name search, certificate, MEMART, status report, and TIN—where applicable) depend on CAC approval and processing. Branding and design perks (such as logos, letterheads, flyers, and stamp designs) are Berhiz package benefits, not government filings. Stamp design includes design only, unless physical production is explicitly included. Google Business Profile benefits provide guidance (Standard) or setup assistance (Premium) but do not guarantee approval, ranking, or visibility. Business or Company Launch Consultations are defined package benefits, not unlimited consulting engagements.
Additional services, filings, corrections, amendments, post-registration services, or government charges not included in the selected package may require additional payment.
5. Client Information
Clients must provide complete, accurate, current, and genuine information required for the applicable registration.
This may include names, addresses, dates of birth, nationality, gender, identification documents, passport photographs, signatures, contact details, business information, director/shareholder information, proposed names, shareholding information, and other information required for the relevant filing.
6. Authority to Submit Information
By submitting an application, the client confirms that they are authorised to provide the information and documents supplied to Berhiz Technologies and, where information relates to another individual, have the necessary authority or lawful basis to provide that information for the intended registration or filing.
7. Accuracy and Responsibility
The client is responsible for reviewing all information supplied for registration and promptly identifying errors or omissions.
Berhiz Technologies may rely on information supplied by the client and is not responsible for errors, delays, rejection, or additional costs resulting from inaccurate, incomplete, misleading, outdated, or unauthorised information supplied by the client.
8. Name Availability
Submission of a proposed business or company name does not guarantee that the name will be available or approved by CAC.
Where a proposed name is unavailable, rejected, reserved by another party, or otherwise unacceptable to CAC, the client may be required to provide alternative names or information.
9. Government Requirements
CAC requirements, procedures, forms, fees, documentation requirements, and processing procedures may change.
Where CAC or another authority introduces a new requirement, requests additional information, or changes a filing procedure, the client may be required to provide additional information or take additional steps.
10. Processing Times
Any processing time stated by Berhiz Technologies is an estimate unless expressly stated otherwise in writing.
Processing may be affected by CAC workload, system availability, public holidays, regulatory requirements, verification processes, name availability, document issues, client delays, technical issues, or other circumstances outside Berhiz Technologies' reasonable control.
11. Government Fees and Third-Party Charges
Where a package expressly includes specified CAC or other official charges, those charges will be handled according to the applicable package terms.
Government fees, levies, penalties, third-party charges, amendments, additional filings, or other costs not expressly included in the selected package may be payable separately by the client.
12. Payment and Application Commencement
Payment for a CAC service does not by itself guarantee registration approval or a particular outcome.
Berhiz Technologies may begin processing after payment has been successfully confirmed and the required client information and documents have been received, subject to the applicable package and service process.
13. CAC Documents and Personal Information
CAC registration may require sensitive personal and business information and supporting documents.
Depending on the service, these may include government-issued identification, passport photographs, signatures, dates of birth, addresses, nationality, gender, director or shareholder information, and other information required for the applicable filing.
The handling of such information is also governed by the Berhiz Technologies Privacy Policy.
14. Temporary Copies of Documents
During the processing of a CAC application, Berhiz Technologies or authorised personnel may temporarily download, save, access, or transfer client documents where reasonably necessary to complete the service.
Such copies must be used only for the intended service and should be securely deleted or otherwise securely disposed of when no longer required, subject to legitimate legal, accounting, regulatory, dispute-resolution, or record-keeping requirements.
15. Confidentiality and Data Protection
Berhiz Technologies will handle client information in accordance with its Privacy Policy and applicable data-protection requirements.
Client information will not be sold for commercial purposes.
Information may be disclosed to CAC, payment providers, relevant service providers, authorised personnel, professional advisers, or authorities where reasonably necessary to provide the service, comply with legal obligations, protect rights, prevent fraud or abuse, or otherwise as permitted by applicable law.
16. CAC Account and Portal Access
Where a CAC process requires access to an account, portal, email address, phone number, verification method, or other client-controlled resource, the client remains responsible for maintaining the security of their credentials and access methods unless otherwise expressly agreed.
Clients should not provide unnecessary passwords or authentication information.
Where temporary access is genuinely necessary, the client should provide only the access reasonably required for the agreed service.
17. Verification and Additional Information
CAC or another relevant authority may request additional information, documents, verification, corrections, or clarification.
The client agrees to provide requested information or assistance promptly where reasonably required to continue the application.
Delays in providing requested information may delay the registration process.
18. Rejections, Queries, and Corrections
CAC may reject, query, return, or require correction of an application.
Where a correction or additional submission is reasonably required because of a CAC requirement, the client may need to provide additional information or documents.
Where an error or omission is caused by information supplied incorrectly or incompletely by the client, additional work or charges may apply where permitted under the applicable service or package terms.
19. Certificates, Official Records and Deliverables
Where CAC issues a certificate, registration document, status report, or other official record, the document and the information contained in it remain subject to CAC's official records and authority.
Berhiz Technologies does not independently guarantee the accuracy of CAC records and will not alter or represent an official CAC record as genuine where it has not been issued by CAC.
Deliverables will be provided digitally (e.g., via WhatsApp, email, or both) or in print, depending on the selected package. Premium packages include physical items such as printed registration documents, printed business cards and letterheads, and framed certificates. Delivery of physical items is subject to separate dispatch and courier timelines.
20. Client Review
Clients should review registration documents, certificates, names, addresses, ownership information, and other submitted or issued information promptly after receiving them.
Any suspected error should be reported to Berhiz Technologies as soon as reasonably possible so that the appropriate correction or clarification process can be considered.
21. Post-Registration Services
Post-registration services, including amendments, changes of particulars, annual returns, business-name upgrades, company changes, additional filings, tax-related services, or other regulatory services are not automatically included unless expressly stated in the selected package or written agreement.
Such services may be subject to separate fees and requirements.
22. Annual Returns and Continuing Compliance
Registration does not necessarily end the client's legal or regulatory responsibilities.
Where applicable, the client remains responsible for continuing obligations such as annual returns, changes in registered information, tax obligations, licences, permits, sector-specific requirements, or other regulatory obligations.
Berhiz Technologies may provide separate services relating to such matters where offered.
23. Third-Party and Government Systems
CAC registration may depend on government systems, payment platforms, identity-verification systems, communication networks, hosting infrastructure, or other third-party services.
Berhiz Technologies does not control the availability, performance, security, policies, or changes of such external systems.
24. No Guarantee of Approval or Outcome
Berhiz Technologies will use reasonable care in providing the agreed registration service but does not guarantee that CAC will approve an application, accept a proposed name, issue a certificate by a particular date, or reach any particular decision.
Any statement about likely processing time, availability, or outcome should not be interpreted as a guarantee unless expressly confirmed in writing.
25. Client Cancellation
Cancellation of a CAC registration service is subject to the Refund, Cancellation & Rescheduling Policy, the applicable package terms, and any mandatory consumer rights or other applicable law.
The fact that a payment has been made does not automatically remove any statutory right that may apply.
26. Refunds
Refunds relating to CAC registration services are governed by the Refund, Cancellation & Rescheduling Policy, the applicable package terms, and mandatory applicable law.
Where work has already been performed, official or third-party costs have been incurred, or a service has progressed substantially, the amount refundable may be affected subject to applicable law and the circumstances of the case.
27. Client Delays
Where the client fails to provide required information, documents, approvals, corrections, verification, or other assistance within a reasonable period, the application may be delayed.
Berhiz Technologies is not responsible for delays caused by the client's failure to provide information or respond to reasonable requests.
28. Fraudulent or Unlawful Applications
Berhiz Technologies may refuse, suspend, or terminate an application where it reasonably suspects that the application involves fraud, impersonation, false documents, misleading information, unlawful activity, unauthorised use of another person's information, or other prohibited conduct.
Where appropriate, relevant information may be disclosed to competent authorities or other parties as permitted or required by law.
29. Communication
Clients are responsible for providing accurate contact information and monitoring communications relating to their application.
Berhiz Technologies may communicate through email, telephone, WhatsApp, or other agreed communication channels.
A delay caused by inaccurate contact information, inaccessible communication channels, or failure to respond may affect processing time.
30. Electronic Communications
The client agrees that electronic communications, application confirmations, payment confirmations, document requests, and service updates may be provided electronically unless another legally required method applies.
Clients should retain important confirmations and documents supplied to them.
31. No Government Agency Relationship
Nothing in these Terms creates a relationship in which Berhiz Technologies is an employee, agent, department, or official representative of CAC or any other government authority.
References to CAC, government requirements, or official processes are made solely to describe the service being facilitated.
32. Changes to CAC Requirements
CAC rules, procedures, fees, forms, systems, and requirements may change after a client has purchased a service.
Where a change materially affects the agreed service, Berhiz Technologies will communicate the relevant change where reasonably practicable and may explain any additional steps or costs that arise.
33. Relationship With Other Policies
These CAC Registration Terms should be read together with the Berhiz Technologies Terms & Conditions, Privacy Policy, and Refund, Cancellation & Rescheduling Policy.
Where a specific written agreement or package term expressly addresses a matter differently, that specific term may apply to the extent permitted by applicable law.
